Spanish nationality processing

Residence (community and non-community)

If a foreigner is married or registered as a common-law partner with a citizen of the European Community, they can apply for the European Citizen's Family Card.

You can also apply for a community card for children, parents of community members and their spouse, and for other family members who are financially dependent, such as an extended family.

When an immigrant lives in Spain for two years, they can apply for residence authorization by roots.

It must be shown that the applicant has been in Spain for two years, and, depending on the case, that they have a work contract and are integrated into Spanish society, or that they have relatives in Spain or that they are interested in training here.

Official translations

On some occasions at Espai Asesores we find Visa or Authorization files that have been denied because the documents provided do not have the relevant official validity. We remind you that when any application is submitted to the Spanish Consulate in your country of origin or residence, or failing that, to the Immigration Office, they must be translated by specific translators for them. An example of this is residents in the United States who present the requirements in English and translated into Spanish, but without a translation. official.

Foreign public documents intended to be presented to the Spanish Administration must meet the following requirements:

  1. It must be an original document or a copy certified by the same body that issued the original document.
  2. Unless there is some legal instrument that exempts this obligation, the foreign public document must be legalized/apostilled to be valid in Spain.
  3. It must be translated into Spanish.

Exceptions: European Union Law.

Regulation (EU) 2016/1191 exempts from translation public documents of an EU Member State that are accompanied by a standard multilingual form of those referred to in its annexes and sworn translations carried out by a person authorized to do so under the law of a Member State of the European Union.

For documents not exempt from translation, only the following translations will be accepted:

  • Carried out in Spain by a sworn translator or interpreter appointed by the Ministry of Foreign Affairs, European Union and Cooperation (MAEUEC) of Spain. These translations are exempt from legalization and are valid without the need for any additional procedure.
  • Made or assumed as their own by a Spanish diplomatic or consular representation abroad. These translations require legalization by the relevant section of the MAEUEC.
  • Carried out by the diplomatic or consular representation in Spain of the State that issues the document. These translations require to be legalized by the relevant section of the MAEUE

Regulation (EU) 2016/1191 exempts the following public documents emanating from a Member State of the European Union from the need to legalize for them to take effect in Spain:

  • Civil Registry Documents (birth, certificate of life, death, marriage, marital capacity, marital status, divorce, separation and annulment).
  • De facto union documents (capacity, condition, cancellation, separation and annulment)
  • Affiliation documents, including adoption
  • Documents related to address, residence, nationality and CAP (criminal record certificate).
